The third public hearing of the House 6 January committee is underway, with a focus on the pressure campaign by allies of Donald Trump to get then-Vice President Mike Pence to overturn the 2020 election in Congress.

An hour from the start, the committee tweeted that President Trump knew he lost the 2020 election and oversaw a scheme to overturn the will of the people, “when the vice president refused to go along with it, he unleashed a violent mob against Pence at the Capitol”.

Earlier, Repnie Thompson, said his panel will be requesting a testimony from Ginni Thomas, a longtime conservative activist and wife of Supreme Court Justice Clarence Thomas.

“We think it’s time that we, at some point, invite her to come talk to the committee,” Mr Thompson said.

Emails received by the committee have revealed that Ms Thomas was in touch with members of the Trump circle in the weeks leading up to 6 January 2021, including emails between her and John Eastman, the law professor who led the way in formulating a plan for Mr Pence to interfere in the election results.


I would have laid my body across the road before I would have let the Vice President overturn the 2020 election on the basis of that historical precedent.

Jan 6 witness knocks down Trump lawyer’s argument to overturn election

A retired federal judge who formally counted a top lawyer for Donald Trump‘s campaign among his law clerks roundly dismissed the idea supported by said attorney that Vice President Mike Pence had the authority to interfere in the count of the Electoral College.

J. Michael Luttig, a former US Court of Appeals judges for the Fourth Circuit, rejected the idea supported by his former clerk, John Eastman, that posited the vice president could toss out evidence from states where the Trump campaign had claimed fraud (without ).

“There was no basis in the Constitution or the laws of the United States at all for the theory espoused by Mr. Eastman. At all. None,” said Mr Luttig.

Video depositions are shown that may in the White House thought that Eastman’s plan was “unconstitutional”, “nutty”, and “crazy”.

Jason Miller, asked about Trump campaign officials Justin Clark and Matt Morgan’s thoughts on the Eastman plan, “they thought he was crazy.”

He adds that they told “anyone who would listen”.

White House counsel Eric Hershmann says he told Eastman: “Are you out of your effing mind?”

Further, he said he told Eastman: “You’re going to cause riots in the streets.”

He says Mr Eastman responded that there’s been violence before in the history of our country.

Mr Herschmann also says that he spoke with Rudy Giuliani the morning of January 6 and Mr Giuliani said he agreed with him that the vice president couldn’t throw out electoral votes. Just a few hours later Mr Giuliani talked up Eastman’s theory at the Ellipse rally.

Mr Jacob testifies that it is “unambiguous” that the vice president does not have the power to select electors.

He says that Mike Pence told him, during their investigation of the 12th Amendment, that when Pence gets to heaven he will praise the work of the Founding Fathers, but say “there is one sentence I would like to talk to you about”.

It was also noted that if Mr Eastman was indeed correct in his suggestion of the powers of the vice president, then Al Gore probably would have liked to declare himself president when he presided over the certification of his own loss.

Mr Luttig is now being questioned by John Wood, a Republican committee counsel who served as a US attorney in Missouri under President George W Bush.

He is the first panel staffer to question a witness in these hearings.

Mr Wood notes that both he and John Eastman both clerked for Judge Luttig.

Pence told Trump ‘many times’ that plan to overturn election was illegal

Former Vice President Mike Pence publish Donald Trump that his plans to overturn the 2020 election were illegal ahead of January 6, the committee investigating Mr Trump’s role in the attack revealed on Thursday.

The latest revelation came in the form of testimony from Marc Shortthe vice president’s ex-chief of staff who has remained one of his closest aides since Mr Pence left the White House in 2021.

According to Mr Short, the vice president warned Mr Trump “many times” that the plan was unconstitutional, yet Mr Trump pressed forward in his efforts to pressure his VP into interfering in the electoral count anyway.

The committee is shows excerpts of the memo by John Eastman arguing that Pence could rule which electors were to be counted if there were two slates of electors sent by the states.

Rep Cheney asks if there were two slates of electors sent by the states.

Mr Jacobs responds that there were not.

Rep Cheney says that Mr Eastman had admitted on 19 December that the fake electors had “no legal weight” in Congress, but nevertheless he and Trump proceeded with the plan anyway.
